Chapter and Introduction

Because you use the service in the country where you are located and the service only applies to the laws of the country where you are located

Welcome to use the "ElephGO" service platform and services!

In order to use the ElephGO Service Platform and Services (hereinafter referred to as the "ElephGO Services" or "We"), you should read and abide by the ElephGO Service Agreement (hereinafter referred to as the "Agreement"). Please read and fully understand the contents of each clause carefully, especially the corresponding clauses that exempt or limit liability, as well as the separate agreement for opening or using a certain service, and choose to accept or not accept it. Restrictions and exemption clauses may be prompted for your attention in bold form.

Unless you have read and accepted all terms and conditions of this agreement, you have no right to use the ElephGO service platform and services. Your login, viewing, operating, and publishing information on this platform and services will be deemed to have read and agreed to be bound by these Terms.

1.1 Scope of application of the agreement

This agreement is the agreement between you and ElephGO Services regarding your use of ElephGO Services Platform (including Weixin Mini Programs, Weixin Official Accounts, H5, apps, etc.) services. "User" refers to the individual who registers, logs in, and uses the ElephGO service platform services, and is more referred to as "you" in this agreement.

1.2 Agreement relationships and conflict clauses

This agreement is the basic service agreement of the ElephGO service platform. The ElephGO Service Privacy Policy, which involves the use of ElephGO service products and other processes, is an integral part of this agreement and forms a unified whole with it.

The content of this agreement also includes relevant agreements, business rules, etc. regarding this service that the ElephGO service may continuously publish. You can review the content of the above agreements and rules at any time through the ElephGO service. If you have any objections or believe that the content is detrimental to your rights and interests, you should immediately stop using the Lao Elephant Travel Service. Otherwise, once the above content is officially released, it will become an integral part of this agreement, and you should also abide by it.

concerning use of the Service

2.1 Content of this service

This service is committed to creating a one-stop comprehensive travel service platform for car owners and public travel users, including local services, travel consulting, shared charging treasure, car rental and other car owner services, as well as public transportation services such as buses and subways, train tickets, and bus tickets.

2.2 Form of this service

2.2.1 You may need to download app client software to use ElephGO service platform services. For these software, the relevant application has given you a personal, non-transferable and non-exclusive license. You can also access old ElephGO service Mini programs or product main pages through external adverti*ts, H5, apps, etc.

2.2.2 When you use ElephGO service platform services, under special circumstances, it may be different from the app client software application versions you downloaded (such as iOS, Android, Windows Phone, Symbian BlackBerry, Windows, etc.) and mobile phone models, and there are differences in individual display effects. However, this does not affect your normal use of any services of the Lao Elephant Travel Service Platform.

user Personal Information Protection

3.1 Protecting users 'personal information is a basic principle of ElephGO services. Laos Elephant Travel Services will take reasonable measures to protect users' personal information. Except as stipulated by laws and regulations, Laos Elephant Travel Service will not disclose or disclose users 'personal information to third parties without the user's permission. ElephGO services use professional encrypted storage and transmission methods for relevant information to ensure the security of users 'personal information.

3.2 When you register for an account or use ElephGO service platform services, we will collect and use your personal information based on the services you require, including your location information and device information. Some functions will also include your identity information, contact information and transaction information. Please read the ElephGO Service Privacy Policy carefully and use the relevant services after confirming your consent. If there are special provisions in Chinese (Lao) national laws, regulations or policies, you need to provide true identity information. If the information you provide is incomplete, you cannot use the ElephGO service platform services or you will be restricted during your use.

3.3 Please do not operate this product or service while driving a vehicle or getting on or off a bus or walking. You must use this product or service on the premise of ensuring safety to prevent traffic accidents or other dangerous situations.

3.4 Under normal circumstances, you can browse and modify the information you submit at any time, but for security and identity reasons, you may not be able to modify the initial registration information and other verification information provided when registering.

3.5 ElephGO Services will use various security technologies and procedures to establish a comprehensive management system to protect your personal information from unauthorized access, use or disclosure.

3.6 Without your consent, ElephGO Services will not disclose your personal information to any company, organization or individual outside the ElephGO Services, unless otherwise provided by laws and regulations.

3.7 ElephGO Service Feitang attaches great importance to the protection of personal information of minors. If you are a minor under the age of 18, you must obtain the written consent of your parent or legal guardian before using the ElephGO service, or use the service under the guardianship of your guardian.

3.8 You can also read the ElephGO Privacy Policy to learn more about how ElephGO services collect, use, store, share and protect your personal information and what rights you have.

Main rights and obligations clause

4.1 Account usage specifications

4.1.1 Account login and use of ElephGO service platform (apps, Weixin Mini Programs, Weixin Official Accounts) depends on registration applications for WeChat and mobile accounts. Therefore, after you complete the account registration procedures, you are not allowed to donate, borrow, rent, transfer or sell the account or otherwise authorize the person who is not the original applicant to use the account to log in or use the ElephGO service platform (apps, Mini programs, public accounts) services.

4.1.2 You are responsible for properly keeping the registered account information and account password and obtaining the security of Laos ElephGO service account information. Users are responsible for the actions under the registered account and password. Users agree not to disclose account and password information to others under any circumstances. When you lose or disclose the aforementioned information due to improper storage or suspect that others are using your WeChat account, your ElephGO service platform account may also be used by others. Therefore, you should immediately notify Tencent and ElephGO operating company. ElephGO services will actively assist you in safeguarding your legitimate rights and interests, but you understand and know that we will not be responsible for all damage and consequences caused by the aforementioned improper storage of your account and password.

4.2 User considerations

4.2.1 You understand and agree that in order to prevent and combat online black and gray industries and ensure the security of ElephGO service platform accounts logged in, we will obtain desensitization and processing information from relevant administrative agencies, judicial agencies, ElephGO service cooperation institutions, related parties and other third parties., de-identified and anonymized information for risk control, anti-fraud, anti-black and gray industries, etc.

4.2.2 You understand and agree that in order to improve our services and optimize our products, we will provide you with personalized services. Your login operations, browsing trajectory, operation methods, etc. on the ElephGO service platform will be recorded. We will obtain desensitization, processing, de-identification and anonymized information from administrative agencies, judicial agencies, ElephGO service partners, related parties and other third parties to provide you with personalized services such as marketing recommendations and information display.

4.2.3 You understand and agree that: Because you use the service at the place of operation, and the service is only applicable to the country of operation, according to our company's regulations, we are not responsible for your safety and accidental injuries during this period for all activities including cycling, tourism and other related activities related to our company's business during your travel to the country of operation. You will purchase relevant insurance for cycling, tourism and other activities, and we will no longer cover them.

4.3 third party products and services

4.3.1 When you use the products or services provided by third parties on the ElephGO service platform, such as local services, travel consultation, shared charging devices, car rental and other car owner services, as well as public transportation services such as buses and subways, train tickets, and bus tickets, you should check the third party's user agreement and privacy policy and other text content yourself. If you confirm that you choose and use the third party's products and services, in addition to complying with the provisions of this agreement, you must also abide by the third party's user agreement. They shall bear their respective responsibilities for possible disputes within the scope stipulated and agreed by law.

4.3.2 You understand and agree that ElephGO has the right to decide on the commercial use of the ElephGO service platform, including but not limited to developing and entrusting part of this platform to third parties to send promotional information to you. ElephGO service promises to protect your personal information in strict accordance with the provisions of this agreement during the promotion process. At the same time, you can also set the option to block or refuse to receive relevant promotional information based on the content of the relevant information link.

User Code of Conduct

5.1 information specification

5.1.1 You understand and agree that the ElephGO service platform mainly provides a platform for ElephGO services on the Internet, and we provide users with functional modules for expressing evaluation and feedback on some functions. You may not use comments and other functions of the ElephGO service platform to create, copy, publish, or disseminate the following content that interferes with the normal operation of the ElephGO service or infringes on the legitimate rights and interests of other users or third parties, including but not limited to:

5.1.2.1 Produce, publish, transmit, and disseminate content that violates national laws and regulations prohibited:

(1)Violating the basic principles established in the Constitution;

(2)Endangering national security, leaking Chinese state secrets, subverting state power, and undermining national unity;

(3)Damage to the honor and interests of the country;

(4)Those who incite ethnic hatred and ethnic discrimination and undermine ethnic unity;

(5)Those who undermine the country's religious policies and promote cults and feudal superstitions;

(6)Spreading rumors, disrupting social order, and undermining social stability;

(7)Spreading obscenity, *, gambling, violence, terrorism or instigating crimes;

(8)Insulting or slandering others, infringing on the legitimate rights and interests of others;

(9)Inciting illegal assemblies, associations, marches, demonstrations, gatherings to disrupt social order;

(10)Activities in the name of illegal non-governmental organizations;

(11)Contains other content prohibited by laws and administrative regulations.

5.1.2.2 Produce, publish, transmit, and disseminate content that infringes on other people's legitimate rights such as reputation rights, portrait rights, intellectual property rights, and trade secrets;

5.1.2.3 Content involving the privacy, personal information or data of others;

5.1.2.4 Post, transmit, disseminate harassing information, advertising information, excessive marketing information and spam information or content that contains any * or * implication;

5.1.2.5 Other content that violates laws, regulations, policies, public order and good customs, social morality or interferes with Lao elephant travel services, normal operation of WeChat, and infringes on the legitimate rights and interests of other users or third parties.

5.2 Platform usage specifications

5.2.1 Unless permitted by law or authorized in writing by ElephGO Services, you are not allowed to engage in the following activities while using ElephGO Services Platform:

5.2.1.1 Delete copyright information on the platform and its copies;

5.2.1.2 Reverse engineer, decompile, decompile the platform, or otherwise attempt to discover the source code of this software;

5.2.1.3 Use, rent, lend, copy, modify, link, reproduce, compile, publish, establish mirror sites, etc., content with intellectual property rights of ElephGO services;

5.2.1.4 Copying, modifying, adding, deleting, hooking or creating any form of derivative work of data released into any terminal memory during the operation of the ElephGO Service Platform, the interaction data between the client and the server during the operation of the software, and the system data necessary for the operation of the platform, including but not limited to the use of plug-ins, plug-ins or third-party tools/services not authorized by the ElephGO Service to access the platform and related systems;

5.2.1.5 Add, delete, or change the functions or operating effects of the platform by modifying or falsifying instructions and data during the operation of the platform, or operate or disseminate software and methods used for the above purposes to the public, whether or not these actions are for commercial purposes;

5.2.1.6 Log in to or use ElephGO service platforms and services, or create, publish, and disseminate the above tools through third-party software plug-ins, plug-ins, and systems developed by non-ElephGO services;

5.2.1.7 By itself or authorizing others or third-party software to interfere with the ElephGO service platform, its components, modules, and data;

5.2.1.8 Other actions not expressly authorized by ElephGO services.

5.2.2 You understand and agree that based on comprehensive factors such as user experience, operating security of the ElephGO service platform, platform rule requirements and healthy development, ElephGO service has the right to choose the objects it provides, decide on functional settings, and decide on functional openness, data interfaces and related data disclosure. You have the right to suspend or terminate the provision of this service as appropriate under the following circumstances, including but not limited to:

5.2.2.1 Violating laws, regulations or the provisions of this Agreement;

5.2.2.2 Affecting the service experience;

5.2.2.3 There are potential safety hazards;

5.2.2.4 Similar or identical to the existing main functions and functional components of the ElephGO service platform or its services, or can achieve the main effects of the above functions or functional components;

5.2.2.5 The interface, style, function, description or user experience is similar to the ElephGO Service Platform and its service platform, which may cause ElephGO Service users to believe that the features or services they use are derived from or authorized by the ElephGO Service;

5.2.2.6 Violating the operating principles of ElephGO services or their service platform, or failing to meet other management requirements of ElephGO services.

5.3 Service Operation Specifications

Unless permitted by law or authorized in writing by ElephGO Services, you are not allowed to engage in the following activities while using ElephGO Services Platform:

5.3.1 Submit or publish false information, or impersonate or use the name of others;

5.3.2 Making up facts or concealing the truth to mislead or deceive others;

5.3.3 Damage to other people's legitimate rights such as reputation rights, image rights, intellectual property rights and trade secrets;

5.3.4 Use the ElephGO service platform account, function account and any functions, as well as third-party operating platforms to promote or promote each other without written permission from the ElephGO service platform;

5.3.5 Use ElephGO service platform account or functional account and services to engage in any illegal and criminal activities;

5.3.6 Produce, publish, operate or disseminate methods and tools related to the above actions, whether or not these actions are for commercial purposes;

5.3.7 Other behaviors that violate laws and regulations, infringe on the legitimate rights and interests of other users, interfere with the Lao Elephant Travel Service, the normal operation of WeChat, or are not explicitly authorized by the ElephGO service platform.

5.4 default treatment

5.4.1 If the ElephGO service platform discovers or receives reports or complaints from others that a user violates the terms of this agreement, the ElephGO service platform has the right to delete or block the relevant content at any time without notice, and impose penalties for account violations, including but not limited to warnings, restrictions or bans on the use of some or all functions, account blocking or cancellation, and announce the results of the handling.

5.4.2 You understand and agree that ElephGO Service Platform has the right to impose penalties for violations of relevant laws and regulations or the provisions of this agreement at reasonable judgment, take appropriate legal actions against any user who violates the law, and store relevant information to relevant departments in accordance with laws and regulations. Report, etc., the user shall bear all legal responsibilities arising therefrom.

5.4.3 You understand and agree that you shall be solely responsible for any claims, demands or losses claimed by third parties resulting from or arising from your violation of this agreement or the relevant service terms; you shall also compensate ElephGO Service Platform for any losses suffered as a result.

intellectual property notices

6.1 ElephGO is the intellectual property rights owner of the ElephGO service platform related platforms. All intellectual property rights such as copyright, trademark rights, patents, trade secrets, etc. of this software, as well as all information related to this software (including but not limited to dry text, pictures, audio, video, charts, interface design, layout frames, related data or application documents, etc.) are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. ElephGO enjoys the above intellectual property rights, except for the rights that relevant rights holders should enjoy in accordance with legal provisions.

6.2 Without the written consent of ElephGO Service Platform or the relevant rights holders, you may not implement, utilize, or transfer the above intellectual property rights by yourself or license any third party for any commercial or non-commercial purposes.

Platform security responsibilities

7.1 You understand and agree that the ElephGO service platform, in addition to being affected by relevant policy and software factors, may also be affected by a variety of factors, including but not limited to user reasons, network service quality, social environment, etc.; it may also be affected by various security issues, including but not limited to illegal use of user data by others to conduct real-life harassment; Other software downloaded and installed by users or other websites visited may contain viruses, Trojans or other malicious programs, which threaten the security of your terminal device information and data, affect the normal use of WeChat software, and then affect the normal use of ElephGO service platform. Therefore, you should strengthen your awareness of information security and personal information protection, and pay attention to password protection to avoid losses.

7.2 You may not create, publish, use, or disseminate malicious programs used to steal WeChat, ElephGO accounts, feature accounts, and other people's personal information or property.

7.3 Maintaining the security and normal use of the ElephGO Service Platform is the joint responsibility of the ElephGO Service Platform and you. The ElephGO Service Platform will take necessary technical measures reasonably and prudently to protect the security of your personal information and data in accordance with industry standards. However, you acknowledge and agree that the ElephGO Service Platform cannot provide full guarantees in this regard.

7.4 Under no circumstances should you be trusting in borrowing money, asking for passwords or other online information involving property. If property operations are involved, please first verify the identity of the other party, and always pay attention to tips on preventing fraud crimes.

8.1 By using the ElephGO service platform and services, you will be deemed to have read and agree to be bound by this agreement. ElephGO Service Platform has the right to modify the terms of this agreement in accordance with laws and regulations, requirements of relevant national authorities or business operation needs. You can review the relevant agreement terms at any time on the ElephGO service platform. After the terms of this agreement are changed, if you continue to use the ElephGO service platform and services, you will be deemed to have accepted the revised agreement. If you do not accept the revised agreement, you should stop using the ElephGO service platform and services.

8.2 The establishment, entry into force, performance, interpretation and dispute resolution of this Agreement shall apply to the country of operation (excluding conflict of laws)

8.3 If any dispute or dispute arises between you and the ElephGO service platform, it shall first be resolved through friendly negotiation; if negotiation fails, you agree to submit the dispute or dispute to the jurisdiction of the court in the jurisdiction where the equipment is operated.

8.4 The titles of all terms of this agreement are for ease of reading only and have no actual meaning in themselves and cannot be used as the basis for the interpretation of the meaning of this agreement.

8.5 No matter what reason the terms of this agreement are partially invalid or unenforceable, the remaining terms are still valid and binding on both parties.

1.2协议关系及冲突条款

本协议是ElephGO服务平台的基础服务协议，涉及ElephGO服务产品使用等流程的《ElephGO服务隐私政策》是与本协议不可分割的组成部分，与其构成统一整体。

本协议内容同时包括ElephGO服务可能不断发布的关于本服务的相关协议、业务规则等内容。您可以随时通过ElephGO服务对上述协议、规则内容进行查阅，如您有任何异议或认为有关内容有损您的权益，您应当立即停止使用老挝大象出行服务。否则，上述内容一经正式发布，即为本协议不可分割的组成部分，您同样应当遵守。

关于本服务

2.1本服务的内容

本服务致力于为车主及公共出行用户打造一站式出行综合服务平台，包括本地服务、旅游咨询、共享充电宝、租车等车主服务，以及公交地铁、火车票、汽车票等公共交通服务内容。

2.2本服务的形式

2.2.1您使用ElephGO服务平台服务可能需要下载app客户端软件，对于这些软件，相关应用已给予您一项个人的、不可转让及非排他性的许可。您也可以通过外部广告、H5、app等方式进入老ElephGO服务小程序或产品主页面。

2.2.2您使用ElephGO服务平台服务时，在特别情况下可能与您下载的app客户端软件应用版本如iOS、Android、Windows Phone、Symbian BlackBerry、Windows等)、手机型号不同，而在个别展示效果上有差异，但这并不影响您正常使用老挝大象出行服务平台的任何服务。

用户个人信息保护

3.1保护用户个人信息是ElephGO服务的一项基本原则老挝大象出行服务将会采取合理的措施保护用户的个人信息。除法律法规规定的情形外，未经用户许可老挝大象出行服务不会向第三方公开、透露用户个人信息。ElephGO服务对相关信息采用专业加密存储与传输方式，保障用户个人信息的安全。

3.2您在注册帐号或使用ElephGO服务平台服务的过程中，我们会基于您需求的服务，收集和使用您的个人信息，包括您的位置信息、设备信息，部分功能中还会包括您的身份信息、联系方式及交易信息。请您认真阅读《ElephGO服务隐私政策》并在确认同意后使用相关服务。若中（老）国家法律法规或政策有特殊规定的，您需要提供真实的身份信息。若您提供的信息不完整则无法使用ElephGO服务平台服务或在使用过程中受到限制。

3.3请您不要在驾驶车辆或上下公交或步行的同时操作本产品或服务，务必在确保安全的前提下使用本产品或服务，以防发生交通事故或其他危险情况。

3.4一般情况下，您可以随时浏览、修改自己提交的信息，但出于安全性和身份识别的考虑，您可能无法修改注册时提供的初始注册信息及其他验证信息。

3.5ElephGO服务将运用各种安全技术和程序建立完善的管理制度来保护您的个人信息，以免遭受未经授权的访问、使用或披露。

3.6未经您的同意，ElephGO服务不会向ElephGO服务以外的任何公司、组织和个人披露您的个人信息，但法律法规另有规定的除外。

3.7ElephGO服务非堂重视对未成年人个人信息的保护。若您是18周岁以下的未成年人，在使用ElephGO服务的服务前，应事先取得您家长或法定监护人的书面同意，或者在监护人的监护下使用本服务。

3.8对于ElephGO服务会如何收集、使用、存储、共享和保护您的个人信息及您享有何种权利，你还可以阅读《ElephGO隐私政策》予以进一步了解。

主权利义务条款

4.1帐号使用规范

4.1.1ElephGO服务平台(app、微信小程序、微信公众号)帐号登录使用依赖于微信和手机账号的注册申请。因此，当您完成账号注册手续后，不得赠与、借用、租用、转让或售卖帐号或者以其他方式许可非初始申请注册人使用帐号登录、使用ElephGO服务平台(app、小程序、公众号)服务。

4.1.2您有责任妥善保管注册帐户信息及帐户密码及以此获得老挝ElephGO服务账户信息的安全，用户需要对注册帐户以及密码下的行为承担法律责任。用户同意在任何情况下不向他人透露帐户及密码信息。当您因保管不当将前述信息丢失、泄露等或怀疑他人在使用您的微信帐号时，您的ElephGO服务平台账户也可能会被他人使用，因此，您应立即通知腾讯及ElephGO运营公司。ElephGO服务会积极协助您维护自己的合法权益，但您理解并知悉，我们不对您前述因账号及密码保管不当问题所导致一切损害及后果承担任何责任。

4.2用户注意事项

4.2.1您理解并同意:为防范和打击网络黑灰产，保障帐户登录下的ElephGO服务平台帐户安全，我们会从相关行政机关、司法机关及ElephGO服务合作机构、关联方等第三方获取脱敏、加工类、去标识化信息和匿名化信息，用于风控、反欺诈、反黑灰产等。

4.2.2您理解并同意:为改进我们的服务、优化我们的产品，从而为您提供个性化服务。您在ElephGO服务平台上的登录操作、浏览轨迹、操作方式等将会被记录。我们会从行政机关、司法机关及ElephGO服务合作机构、关联方等第三方获取脱敏、加工类、去标识化信息和匿名化信息，用于为您提供营销推荐、信息展示等个性化服务。

4.2.3您理解并同意:因您在运营地使用使用该服务，且该服务仅适用于运营地国家,根据我公司规定，您出行运营地国家期间所有包含骑行、旅游等相关我公司业务的活动，本公司不负责您在此期间的安全保障和意外伤害，骑行、旅游等活动由您自行购买相关保险，本公司不再涉及。

4.2.4注销账号

您可以通过路径:“app左上角大象图标-注销账户”注销您的ElephGO账号。

在您注销ElephGO账号后，我们将停止为您提供ElephGO的全部产品和/或服务，并依据法律法规相关要求通过匿名化的方式处理您的个人信息，或删除与您账号相关的个人信息，但法律法规或监管机构对用户信息存储时间另有规定的除外。

4.3第三方产品和服务

4.3.1您在使用ElephGO服务平台上的第三方提供的产品或服务时，如本地服务、旅游咨询、共享充电宝、租车等车主服务，以及公交地铁、火车票、汽车票等公共交通服务内容，您应当自行查阅第三方的用户协议及隐私政策等文本内容，您确认选择并使用第三方产品及服务的，即除遵守本协议约定外，还应遵守第三方的用户协议。对可能出现的纠纷在法律规定和约定的范围内各自承担责任。

4.3.2您理解并同意，ElephGO权决定ElephGO服务平台的商业用途，包括但不限于开发、将本平台的部分委托第三方向您发送推广类信息，ElephGO服务承诺在推广过程中严格按照本协议约定保护您的个人信息，同时您亦可以根据相关信息链接内容，设置选择屏蔽、拒绝接收相关推广信息。

用户行为规范

5.1信息规范

5.1.1您理解并同意，ElephGO服务平台主要为互联网ElephGO服务提供平台，我们在一些功能上为用户提供了发表评价反馈意见的功能模块。您不得利用ElephGO服务平台评论等功能制作、复制、发布、传播如下干扰ElephGO服务正常运营，以及侵犯其他用户或第三方合法权益的内容，包括但不限于:

5.1.2.1制作、发布、传送、传播违反国家法律法规禁止的内容:

(1) 违反宪法确定的基本原则的;

(2)危害国家安全，泄露中国家秘密，颠覆国家政权，破坏国家统一的 ;

(3)损害国家荣誉和利益的;

(4)煽动民族仇恨、民族歧视，破坏民族团结的；

(5)破坏国家宗教政策，宣扬邪教和封建迷信的；

(6) 散布谣言，扰乱社会秩序，破坏社会稳定的；

(7) 散布淫秽、色情、赌博、暴力、恐怖或者教唆犯罪的;

(8)侮辱或者诽谤他人，侵害他人合法权益的;

(9)煽动非法集会、结社、游行、示威、聚众扰乱社会秩序;

(10)以非法民间组织名义活动的;

(11) 含有法律、行政法规禁止的其他内容的。

5.1.2.2制作、发布、传送、传播侵害他人名誉权、肖像权、知识产权、商业秘密等合法权利的内容;

5.1.2.3涉及他人隐私、个人信息或资料的内容;

5.1.2.4发表、传送、传播骚扰信息、广告信息、过度营销信息及垃圾信息或含有任何性或性暗示的内容;

5.1.2.5其他违反法律法规、政策及公序良俗、社会公德或干扰老挝大象出行服务、微信正常运营和侵犯其他用户或第三方合法权益的内容。

5.2平台使用规范

5.2.1除非法律允许或ElephGO服务书面许可，您使用ElephGO服务平台服务过程中不得从事下列行为:

5.2.1.1删除平台及其副本上关干著作权的信息;

5.2.1.2对平台进行反向工程、反向汇编、反向编译，或者以其他方式尝试发现本软件的源代码;

5.2.1.3对ElephGO服务拥有知识产权的内容进行使用出租、出借、复制、修改、链接、转载、汇编、发表出版、建立镜像站点等;

5.2.1.4对ElephGO服务平台运行过程中释放到任何终端内存中的数据、软件运行过程中客户端与服务器端的交互数据，以及平台运行所必需的系统数据，进行复制、修改、增加、删除、挂接运行或创作任何衍生作品形式包括但不限于使用插件、外挂或非ElephGO服务经授权的第三方工具/服务接入平台和相关系统;

5.2.1.5通过修改或伪造平台运行中的指令、数据，增加、删减、变动平台的功能或运行效果，或者将用于上述用途的软件、方法进行运营或向公众传播，无论这些行为是否为商业目的;

5.2.1.6通过非ElephGO服务开发，授权的第三方软件插件、外挂、系统，登录或使用ElephGO服务平台及服务、或制作、发布、传播上述工具;

5.2.1.7自行或者授权他人、第三方软件对ElephGO服务平台序及其组件、模块、数据进行干扰;

5.2.1.8其他未经ElephGO服务明示授权的行为。

5.2.2您理解并同意，基于用户体验、ElephGO服务平台运营安全，平台规则要求及健康发展等综合因素，ElephGO服务有权选择提供服务的对象，有权决定功能设置，有权决定功能开放、数据接口和相关数据披露的对象和范围。针对以下情形，有权视具体情况中止或终止提供本服务，包括但不限于:

5.2.2.1违反法律法规或本协议规定的;

5.2.2.2影响服务体验的;

5.2.2.3存在安全隐患的;

5.2.2.4与ElephGO服务平台或其服务已有主要功能可功能组件相似、相同，或可实现上述功能或功能组件的主要效用的;

5.2.2.5界面、风格、功能、描述或使用者体验与ElephGO服务平台及其服务平台类似，可能造成ElephGO服务用户认为其所使用的功能或服务来源于ElephGO出行服务或经ElephGO服务授权的;

5.2.2.6违背ElephGO服务或其服务平台运营原则，或不符合ElephGO服务其他管理要求的。

5.3服务运营规范

除非法律允许或ElephGO服务书面许可，您使用ElephGO服务平台服务过程中不得从事下列行为:

5.3.1提交、发布虚假信息，或冒充、利用他人名义的;

5.3.2虚构事实、隐瞒真相以误导、欺骗他人的;

5.3.3损害他人名誉权、当像权、知识产权商业秘密等合法权利的;

5.3.4未经ElephGO服务平台书面许可利用ElephGO服务平台帐号功能帐号和任何功能，以及第三方运营平台进行推广或互相推广的;

5.3.5利用ElephGO服务平台帐号或功能帐号及服务从事任何违法犯罪活动的;

5.3.6制作、发布与以上行为相关的方法、工具，或对此类方法、工具进行运营或传播，无论这些行为是否为商业目的;

5.3.7其他违反法律法规规定、侵犯其他用户合法权益、干扰老挝大象出行服务、微信的正常运营或ElephGO服务平台未明示授权的行为。

5.4违约处理

5.4.1如果ElephGO服务平台发现或收到他人举报或投诉用户违反本协议约定的，ElephGO服务平台有权不经通知随时对相关内容进行删除、屏蔽，并视行为情节对违规帐号处以包括但不限于警告、限制或禁止使用部分或全部功能、帐号封禁直至注销的处罚，并公告处理结果。

5.4.2您理解并同意，ElephGO服务平台有权依合理判断对违反有关法律法规或本协议规定的行为进行处罚，对违法违规的任何用户采取适当的法律行动，并依据法律法规保存有关信息向有关部门报告等，用户应独自承担由此而产生的一切法律责任。

5.4.3您理解并同意，因您违反本协议或相关服务条款的规定，导致或产生第三方主张的任何索赔、要求或损失，您应当独立承担责任;ElephGO服务平台因此遭受损失的，您也应当一并赔偿。

知识产权声明

6.1ElephGO是ElephGO服务平台相关平台的知识产权权利人。本软件的一切著作权、商标权、专利权、商业秘密等知识产权，以及与本软件相关的所有信息大容(包括但不限干文字、图片、音频、视频、图表、界面设计、版面框架、有关数据或申子文档等)均受中华人民共和国法律法规和相应的国际条约保护，ElephGO享有上述知识产权，但相关权利人依照法律规定应享有的权利除外。

6.2未经ElephGO服务平台或相关权利人书面同意，您不得为任何商业或非商业目的自行或许可任何第三方实施、利用、转让上述知识产权。

平台安全责任

7.1您理解并同意，ElephGO服务平台一样，除受到相关政策软件因素影响以外，还可能会受多种因素影响，包括但不限于用户原因、网络服务质量、社会环境等;也可能会受各种安全问题的侵扰，包括但不限于他人非法利用用户资料，进行现实中的骚扰;用户下载安装的其他软件或访问的其他网站中可能含有病毒、木马程序或其他恶意程序，威胁您的终端设备信息和数据安全，影响微信软件的正常使用，继而影响ElephGO服务平台的正常使用等。因此，您应加强信息安全及个人信息的保护意识，注意密码保护，以免遭受损失。

7.2您不得制作、发布、使用、传播用于窃取微信、ElephGO帐号、功能帐号及他人个人信息、财产的恶意程序。

7.3维护ElephGO服务平台安全与正常使用是ElephGO服务平台和您的共同责任，ElephGO服务平台将按照行业标准合理审慎地采取必要技术措施保护您的个人信息和数据安全，但是您承认和同意ElephGO服务平台并不能就此提供完全保证。

7.4在任何情况下，您不应轻信借款、索要密码或其他涉及财产的网络信息。涉及财产操作的请一定先核实对方身份，并请经常留意有关防范诈骗犯罪的提示。

其他

8.1您使用ElephGO服务平台及服务即视为您已阅读并同意受本协议的约束。ElephGO服务平台有权根据法律法规、国家有关机关要求或业务运营的需要修改本协议条款。您可以随时在ElephGO服务平台中查阅相关协议条款。本协议条款变更后，如果您继续使用ElephGO服务平台及服务，即视为您已接受修改后的协议。如果您不接受修改后的协议，应当停止使用ElephGO服务平台及服务。

8.2本协议的成立、生效、履行、解释及纠纷解决，适用所在运营国家(不包括冲突法)

8.3若您和ElephGO服务平台之间发生任何纠纷或争议首先应友好协商解决;协商不成的，您同意将纠纷或争议提交在设备运营管辖权区域内的法院管辖。

8.4本协议所有条款的标题仅为阅读方便本身并无实际涵义，不能作为本协议涵义解释的依据。

8.5本协议条款无论因何种原因部分无效或不可执行，其余条款仍有效，对双方具有约束力。
